Definitions

The Owner: Mr Bouncy Castle Ltd

The Equipment: The property of the Owner along with all ancillary equipment

The Hirer: The organisation or individual who enters into the contract with the Owner to hire The Equipment.

User(s): Person(s) using the Equipment

Terms of Hire

The Hirer must be over the age of 18 and accepts the responsibility for the operation and safekeeping of the Equipment. If the Hirer hires the Equipment on behalf of an organisation, the Hirer takes responsibility for the terms of the contract. The Owner hires the equipment to The Hirer on the following terms and conditions.

A contract is deemed to commence when instructions have been received from the Hirer and accepted by the Owner and finishes when all parties have discharged their contractual obligations. The Hirer’s responsibility commences on receipt of the Equipment and ends when the Hirer is in possession of the Owner’s unqualified receipt of the Equipment. The Hirer agrees that they will not sell or otherwise part with control of the equipment.

  1. The Owner has Public Liability Insurance in place which covers any damage caused by our staff or the failure of the equipment. The Insurance Policy doesn’t cover the negligence of the Hirer or any staff the Hirer uses for supervising the inflatable. It is at the hirers discretion as to whether they obtain suitable Public Liability Insurance (minimum £5m).

  2. Re-hiring of the equipment to a third party is expressly forbidden, except with the prior approval and written permission of The Owner.

  3. The Hirer agrees to comply with all the Safety Procedures listed below and accepts full responsibility for providing an adult to supervise at all times. The Owner will provide the Hirer with a Safety Guide when booking, and it is the responsibility of the Hirer to understand the content and comply with any safety instructions.

  4. The Hirer agrees that the equipment is used at the User’s own risk. The Owner is not responsible for accidents to any User or damage to any property caused by the Hirers negligence.

  5. The Hirer shall assume full responsibility for any damage or loss to The Equipment or part thereof. Where The Equipment is lost or stolen and cannot be retrieved, The Hirer agrees to pay the Owner the manufacturer’s recommended selling price. The Hirer agrees to pay the Owner all costs incurred by the Owner in rectifying the condition of the Equipment if it is returned damaged or stained. The Hirer agrees to continue paying the hire costs until the Equipment has been returned in the same condition as provided or replaced.

  6. The Hirer will maintain, throughout the period of the hire, the equipment in good working order and agrees to return the Equipment in a clean condition. The Hirer must notify the Owner of any breakdowns or unsatisfactory working of the equipment without delay. The Hirer must not attempt to repair The Equipment unless authorised by the Owner

  7. The Owner shall not be liable for any third-party expenses, liability loss, claims or proceedings whatsoever, caused by or arising out of late delivery, non-delivery, unsuitability or repossession of the equipment or any part thereof.

  8. The Hirer hereby authorises The Owner to enter upon any premises wherein The Owner deems it necessary to inspect, repair, replace or re-possess the Equipment.

Cancellation

  1. The Owner reserved the right to cancel the hire and offer alternative equipment, should the original unit be unavailable owing to circumstances beyond the control of the Owner

  2. If the Owner cancels a booking due to heavy rain, strong winds, or any unforeseen circumstances, the Hirer will receive a full refund.

  3. If the Hirer cancels a booking, they will be liable to pay up to 25% of the total booking cost.

  4. If the Hirer cancels a booking less than 2 weeks before the booking date, they will be liable to pay up to 50% of the total booking cost.

  5. The Owner will give the Hirer the option to change the booking date at no extra cost, subject to availability and all other booking details remaining the same. This must be redeemed within 6 months of the original booking date.

  6. In the event of government restrictions, the Owner will give the Hirer the option to move the booking date up to 12 months in advance of the original booking date. If the new booking date is more than 6 months in advance of the original booking, the deposit will still be fully transferable, however, a new invoice will be issued based on current pricing for the new period.

Adverse Weather Conditions

  1. The Hirer agrees that the Equipment will not be used during weather conditions deemed to endanger the safety of Users e.g high winds, heavy rain, storms

  2. If the Hirer cancels a booking due to heavy rain or winds, they will receive a full refund minus a £24 administration fee.

  3. The Owner will give the Hirer the option to change the booking date at no extra cost, subject to availability and all other booking details remaining the same. This must be redeemed within 6 months of the original booking date.

By making a booking online, the hirer accepts the above conditions.

Payments

  1. Mr Bouncy Castle accept payments via BACS to the following business bank account: Mr Bouncy Castle Ltd, sort code: 09-01-27, 9227 8730

  2. Cash payments are accepted for bookings less than £150 and must be paid upon delivery to the driver

  3. Mr Bouncy Castle would prefer not to receive payment via cheque, however, we are aware some schools still only have this as a payment option. For school event bookings where BACS payments are not possible, we can accept cheques, but we must receive the full amount in one single payment. Cheques can be sent to the following address:

Safety Procedures

Please note that all persons using the inflatables, do so at their own risk. These guidelines are for the safety of all children using the Equipment, it is the sole responsibility of the Hirer to ensure they are adhered to and the Equipment is used safely.

It is the responsibility of the hirer to ensure that all possible steps are taken to avoid injury to users or damage to the inflatable and that the following safety instructions are followed.

All the Mr Bouncy Castle equipment is up to date with the relevant documentation and safety certificates. You can view our PIPA testing certificates on the Health and Safety section of our website.

The team delivering your inflatable(s) will check over the equipment to ensure it is clean and free of debris and inspect the area for suitability. In advance of our arrival please review the following:

Customers Responsibility prior to our arrival

  • Ensure the area is clear of any large stones, sharp objects or animal droppings

  • The power cable will have a clear runway from the power supply to the inflatable. They must not cross any driveways, roads or major walkways

  • Please have a clear idea of where you would like the castle erected, you must never try and move the Bouncy Castle yourself

  • Please make sure access to the hire site is clear of any vehicle and other obstructions

Customers responsibility during the hire

The inflatable must always been supervised by at least one adult, over the age of 18, and the following safety rules must be adhered to:

  • Mixing children of different size/age can put the smaller ones at risk of injury

  • Never switch the inflatable off and on again while children are around

  • No acrobatics

  • Ensure the castle doesn’t exceed the max number of users (labelled on the side of each)

  • Ensure children don’t climb the side walls or bounce on any part of the inflatable that is not designed for bouncing (slide arches, slide platform & entrance steps)

  • Shoes should be removed, along with any hard or sharp objects, jewellery or clothing

  • Prevent boisterous behaviour, somersaults and rough play

  • Food, drink or chewing gum should not be consumed on the castle

  • Limit the number of children using the inflatable. The max number will be shown on each of the inflatables.

  • No smoking near the inflatable

  • Entrance and exits from the inflatable must not be obstructed

  • The fan must be kept upright at all times and the vents kept clear. Nothing should be touching the sides as it could obstruct the air flow.

  • Care must be taken to ensure nobody trips over the anchorage points or the extension wire

Childrens Inflatables

Any product found outside of the "adult sized inflatables" section on the website, are suitable for children only, up to a maximum age of 11 years. If a child under the age of 11 is taller than the walls of the inflatable, whilst standing on the bounce area, the inflatable is unsuitable for them.

Safety guide during high winds or heavy rain

Mr Bouncy Castle will never set up an inflatable if the wind speeds are predicted to exceed 24 mph. It is also advisable for you to keep an eye on the weather during a particularly windy day. If you don’t have an anemometer, there are ways of checking the wind speed using observations in your surroundings. If you notice any of the effects described below under Force 6 or stronger, you should deflate the Bouncy Castle. Please make sure children are safely away from the area before doing so.

Force 6 (25 - 31 mph) Large branches of trees in motion; whistling heard in telephone wires; difficulty using an umbrella; wind is visibly deforming the frame of the inflatable

PLEASE ENSURE THE INFLATABLE IS NEVER SWITCHED OFF AND ON AGAIN WHILE CHILDREN ARE AROUND. If the inflatable is switched on while children are on top of the deflated plastic, they could end up high on the side walls or on top of the castle and fall from an unsafe height.

In the event of heavy rain, the electricity supply must be disconnected and the extension lead and fan must be taken indoors or covered with a waterproof cover.

Equipment Failure

In the event of a defect or breakdown in equipment, the inflatable must be immediately deflated and the hirer must then contact Mr Bouncy Castle. The unit must not then be re-used until Mr Bouncy Castle advises it is safe to do so.

In the event of a power failure, the hirer must ensure all the children are quickly evacuated from the unit.

Safety for Public Events

The hirer must set up crowd control methods if appropriate. It is recommended that barriers should be a minimum of 1m high and capable of withstanding people leaning on them.

Safety when hiring a generator

  • No smoking, naked flames or sparks should be near the area

  • If it is a long event and a refill is required, please ensure this is only done by the person shown by the Mr Bouncy Castle team during delivery. NEVER refill a generator while it is switched on

  • Ensure the fuel cap is secured firmly on the fuel tank

  • The reserve fuel should be stored in a safe, secure, well-ventilated area and only in the Mr Bouncy Castle approved container.

  • Petrol generators are for outdoor use only and must not be used in enclosed spaces
